Potential Refund for ACA Taxes - action needed by 7/15/2020

A pending Supreme Court case may provide refund opportunities for certain 2016 taxes

 The Supreme Court will be reviewing the constitutionality of the Patient Protection and Affordable Care Act (ACA) of 2010 which if found to be unconstitutional, could impact taxes enacted and paid under provisions of this law, including :

  • the 3.8% Net Investment Income Tax, imposed on those with AGI over $200,000 for single taxpayers and $250,000 for married taxpayers
  • the .9% Additional Medicare Tax, imposed on those with the same AGI limits as the 3.8% tax

In order to protect your right to a refund for your timely filed 2016 tax return, a protective claim must be filed no later than July 15th, 2020.  (There is additional time to file if you filed an extension for that year.) These claims need to be filed now even though the Supreme Court may not issue a ruling until late 2020 or 2021.
