California FTB Refunds 2022 Payments in Error

The California Franchise Tax Board (FTB) has notified tax preparers that over 3000 pass through entity payments made for the 2022 tax year have been refunded in error.  These are payments that were originally made with a 2022 FTB 3893 Voucher.  

If you received a refund, you will need to resubmit that elective tax payment.  The FTB has confirmed that your election with then be valid as of the effective date of the original payment.  (Generally by June 15, 2022). 

What to do: 

A. If you are holding the refund check, please return it to the Franchise Tax Board with the note “PTE Elective Tax Erroneous Refund” and include an FTB 3893 Voucher, Or contact your tax preparer for assistance.

B.  If you deposited the check or received a refund by direct deposit, you can either use Web Pay to pay online or mail a check, payable to Franchise Tax Board.

Write the entity ID, tax year 2022, and include a FTB 3893 Voucher, with an explanation “PTE Elective Tax Erroneous Refund” on the payment and mail to:

NOTE: If you are subject to the mandatory electronic payment (epay) requirement, do not use the mail in option.
The mandatory epay requires taxpayers to submit all payments electronically.
Penalties apply if paid by other means. Go to ftb.ca.gov and search for Web Pay.
